Former Commissioner Of Police Loses Appeal
The attorney, Karen De Freitas-Raitt who represented the Attorney General and the then Justice Minister, Colin Derrick, in the Gary Nelson case says she is optimistic the matter will not go any further.
The Eastern Caribbean Supreme Court of Appeal has ruled against the former commissioner of police, who claimed in part that he had legitimate expectation to be employed for two years as his contract had stipulated.
The Court also ruled that the Police Service Commission and Derrick had not acted irrationally in his termination, which came within six months of his appointment as police commissioner in 2008.
The attorney says that although the Canadian can seek further re-dress, she believes the ruling of the court is clear.
Gary Nelson moved to the Appeals’ Court after a High Court judge had dismissed his application for judicial review.
