ICJ RULES IN FAVOUR OF SIDS IN CLIMATE CHANGE ADVISORY OPINON
In a decision in favour of Small Island Developing States, including Antigua, The International Court of Justice (ICJ) has ruled unanimously Wednesday that states have an obligation to protect the environment from greenhouse gas emissions with a focus on due diligence and cooperation.
The court’s ruling says states are legally bound by international climate change treaties such as the United Nations Framework Convention on Climate Change. The Court adds if States breach these obligations, they will be held responsible, such as being required to cease any wrongful conduct, offer guarantees of non-repetition and make full reparation for any harm caused, depending on the circumstances.
